Big news of Gujarat: The High Court gave this order on the issue of implementation of women's reserve

The Gujarat High Court has directed the state government and the Gujarat Public Service Commission on the issue of implementation of women's reserves in the state. Has issued guidelines for compliance with the provisions of the women’s reserve and has given insight into the implementation of straight-line reserves.

  • HC's directive on implementation of women's reserve in the state
  • Important decision of Gujarat High Court on the issue of women's reservation
  • Like men, women will benefit from open categories and reserves

It has been suggested to implement the provisions of women reserve in 7 phases. The High Court has given the precedent for horizontal reservation for women. If there is a recruitment for 100 seats then the example of straight line women is given for reservation. Such as 17 women in the open category, 4 women in the Scheduled Castes, 6 women in the Scheduled Tribes and seven women in the Socially and Economically Backward Classes on 100 seats. 3% women's reserve for women who are missing the number of women to complete in that category, then to include women in the merit list by reducing the number of male candidates in that category.

So the Gujarat High Court has made an important decision on the issue of women's reservation. The High Court has quashed some provisions of the circular dated 1-8-2018 by the state government on the issue of reservation.

The court upheld the appeals challenging the provisions 12 and 13 of the circular. According to the resolution, a woman belonging to the reserved category is included in the merit but if she wants to seek for the women's reserve, she can be considered in the reserved category.

Submission that the provisions of the Government Circular are contrary to the rules

Importantly, this provision of the government circular was submitted to the court as being contrary to the recruitment rules. The court's order will have a direct impact on women candidates in the open category on merit.

This counts only in the open category and not in the reserved category. Now men will get the same benefits of open category and reserves as women will now get the benefits of open category and reserves.
